2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126 (2), 115 (2), 118 (1), 109 (1), 74, 329 (3), 303 (2), 352, 351 (2) and 3 (5) of the BNS.
3. The case of the prosecution, in short, is that the petitioner, along with others, arrived at the door of the informant and started abusing her. It is further alleged that one Pratima Devi knocked the informant down. Thereafter, Juit Chowdhury assaulted the informant with a sharp-cutting weapon on her head, due to which she fell down. It is also alleged that all the accused persons assaulted her with slaps and fists. It is
Patna High Court CR. MISC. No.13997 of 2026(4) dt.18-04-2026 2/3 specifically alleged that Juit Chowdhury slapped the one-and-ahalf-year-old child, causing the child to fall, which resulted in the child's death.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the FIR is in two parts: in the first part, there are general and omnibus allegations against all the accused persons, and in the second part, there is a specific allegation against Juit Chowdhury. It is further submitted that the allegation against the petitioner is general and omnibus in nature. As regards the injuries of the informant, it is submitted that she was not treated anywhere, and even the learned trial court has not recorded any injury. The main thrust of the allegation is against Juit Chowdhury. Moreover, the petitioner is languishing in judicial custody since 05.11.2025 having no criminal antecedent.
5. Learned counsel for the informant has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Srinagar P.S. Case No. 271 of 2025 on
Patna High Court CR. MISC. No.13997 of 2026(4) dt.18-04-2026 3/3 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran/concerned Court.
