The petitioner seeks bail in a case registered for the offence under Section 387 of the Indian Penal Code. As per the prosecution case, while the petitioner was in Central Jail, Motihari, he demanded rangdari (extortion) of Rs. 1,00,000/- (One lac) from the informant through his mobile and on search, one mobile phone was recovered from his possession in Central Jail, Motihari.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. The alleged mobile does not belong to this petitioner and he is in custody in this case since 28.01.2021.

However, learned A.P.P. for the State opposed the bail

Patna High Court CR. MISC. No.14529 of 2022(2) dt.12-05-2022 2/2 petition and submitted that petitioner is accused in eight more criminal cases.

Considering the nature of accusation and criminal antecedent of petitioner, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
