JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2017 The petitioners seek regular bail in connection with Kanti P.S. Case No. 192 of 2017, registered for offences punishable under Sections 458, 461, 379, 427/34 of Indian Penal Code. Prosecution case is that petitioners came on two motorcycles at the petrol pump to get the petrol and when the informant asked them for money, one of the petitioners threatened him on the point of pistol and on hulla, they were caught at the spot but one of the petitioners fled away from the spot and came back with seven - eight persons armed with iron rod and tried to commit loot and in the meantime, police reached at the spot and they were caught.

It has been submitted on behalf of the petitioners that they have falsely been implicated in this case. It has further been submitted that as there was marriage in the house of the

No.33904 of 2017 (3) dt.08-08-2017 petitioners, they had gone to get the diesel from the petrol pump, where some hot altercation took between the parties, for that they have been implicated in this case. Petitioners have no criminal antecedents and have been in judicial custody since 01.06.2017. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case, at present, I am not inclined to release the petitioners on bail, their application for regular bail is, accordingly, rejected.

However, the petitioners may renew their prayer for bail after framing of charge in this case.
