The petitioner seeks bail in S. Tr. No. 10/2019, arising out of Karja P.S. Case No. 123/2018, instituted for offences under Section(s) 452, 326(A), 307 and 302 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. F.I.R. is against unknown.

It is alleged in the written report that on the date of occurrence while father of informant along with his four year old daughter was sleeping on Chauki, in the meantime, at about 1:00 A.M. in the night some unknown persons poured acid on them. Father of informant and his daughter raised alarm.

No.13885 of 2019(3) dt.28-05-2019 2/2 Hearing the sound, informant and other family members rushed there but the accused persons, who had thrown the acid, had already fled away. Father of informant and his daughter were taken to hospital for treatment. Subsequently, father of informant died during course of treatment.

Case diary has been received.

Learned Addl. P.P. after looking into case dairy has submitted that the deceased in para 17 has raised suspicion against this petitioner.

Learned counsel for the petitioner has submitted that besides suspicion there is no other material against this petitioner. Petitioner is in custody since 06.11.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge Xth, Muzaffarpur, in connection with S. Tr. No. 10/2019, arising out of Karja P.S. Case No. 123/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
