Mr.Ashraf Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Perused the record and heard learned counsel for the State through video conferencing in view of the total lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with Special Case No. 854 of 2020 arising out of Ramkrishna Nagar P.S. Case No.39 of 2020 registered for offence punishable under sections 30 (A) of the Bihar Prohibition and Excise Act.

Allegation has been made that about 28.770 litres of illegal wine has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.01.2020.

Considering the aforesaid facts, the petitioner, named

Patna High Court CR. MISC. No.12640 of 2020(2) dt.13-05-2020 2/2 above, is directed to be released on bail on his personal bond to the satisfaction of Special Judge, Excise, Patna, in connection with Special Case No. 854 of 2020, arising out of Ramkrishna Nagar P.S. Case No.39 of 2020 subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
