The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 365, 302, 201 & 120B/34 of the Indian Penal Code.
This is the second attempt of the petitioner for bail. Earlier vide a detailed order dated 27.06.2019, the prayer for bail of the petitioner was rejected.
Vide order dated 17.08.2021, a report was called for from the learned Court below regarding the stage of the trial. In compliance thereof, the learned A.D.J.-IV, Gaya has sent a report dated 23.08.2021, which is at Flag 'R' to this application. The learned Judge has, inter alia, stated that six months time is likely to be consumed in conclusion of the trial.
Patna High Court CR. MISC. No.24345 of 2021(3) dt.28-10-2021 2/2 Having heard learned counsel for the parties and perusing the case record, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby rejected. However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within six months from the date of receipt/production of a copy of this order. Both the parties are expected to extend their co-operation in conclusion of the trial. The Superintendent of Police, Gaya is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
Let a copy of this order be sent to the Superintendent of Police, Gaya for needful.
