The petitioner seeks bail in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 119 of 2017 dated 24.02.2017 instituted for the offences under Sections 420, 379 of the Indian Penal Code.

Approximately 1,15,000/- belonging to the informant has allegedly been siphoned off by stealing his ATM card.

From the F.I.R, it appears that while the informant was attempting to take out Rs. 5000/- from his bank account, he was informed that the entire money has been taken away. During the course of investigation, it came to light that Rs. 1000/- was transferred in the account of the petitioner. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.48400 of 2017 (3) dt.28-11-2017 2/2 the ATM card of the informant may have been stolen by somebody and money might have been transferred in the account of the petitioner. It has further been argued on behalf of the petitioner that if the petitioner would have been in possession of the ATM card of the informant, he would not have stopped at transferring Rs. 1000/- only. Except for the remittance of Rs. 1000/- in the account of the petitioner, there is no other material connecting the petitioner with the crime.

The petitioner is in custody since 31.07.2017. Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 119 of 2017, G.R. No. 542 of 2017.
