05-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Choraut P.S. Case No. 80 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. It is submitted on behalf of petitioner that specific allegation of assault is against co-accused Ram Bol Mukhiya and only one injury has been found by the doctor on the person of the informant. So far as petitioner is concerned, there is general and omnibus allegation. It is further submitted that alleged occurrence has taken place on 30-10-2019, whereas, F.I.R. has been lodged belatedly on 09-11-2019. Petitioner is having no criminal antecedent.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender

Patna High Court CR. MISC. No.13041 of 2020(2) dt.05-03-2020 2/2 within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Choraut P.S.
