JUSTICE ALOK KUMAR PANDEY ORAL ORDER (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) 05-08-2024 The present L.P.A. was filed in the year 2019. Office has raised office objection on 22.02.2019. It was not complied for about 4 years. Even excluding Covid-19 period, appellants had sufficient time to comply before Covid 19 and after Covid19 period. Appellants are not serious about pursuing this L.P.A.

Patna High Court L.P.A No.294 of 2019(9) dt.05-08-2024 2/2 in view of the fact that office objection has not been attended timely. However, on 28.07.2023 defect has been ignored.

2. During pendency of the present L.P.A., contesting respondent-Kari Chandra Paswan has died in the month of May, 2024. In this regard, we had passed order on 08.07.2024. Even after lapse of about nearly one month, appellants have not taken any steps for filing interlocutory applications for substitution and other interlocutory applications like condonation application and to set aside abatement proceedings.

3. Resultantly, the present L.P.A. stands dismissed with cost of Rs. 5,000/- (Rs. Five Thousand). Cost shall be deposited in the Patna High Court Legal Services Committee, Patna within a period of eight weeks from today. (P. B. Bajanthri, J) ( Alok Kumar Pandey, J) manish/- U
