JUSTICE ARUN KUMAR ORAL ORDER 13-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bakhtiarpur P.S.Case No. 99 of 2017 registered under Sections 304B/34 of the Indian penal Code and 3 and 4 of the Dowry Prohibition Act.

Allegation in brief is that informant's sister was killed by the accused persons, as further demand of dowry was not fulfilled, and there is also allegation that husband of his sister had illicit affair with one Hema Kumari and on that account she was being tortured and killed.

Submission is that marriage was solemnized six years back and there is no any specific allegation of making demand of dowry against the petitioner rather the allegation is of against the deceased husband having illicit affair with a lady and on that account she committed suicide.

Patna High Court Cr.Misc. No.21745 of 2018(2) dt.13-04-2018 2/2 Having considered the aforesaid facts and circumstances, as the allegation appears specific against the husband of the deceased and not against the father-in-law, so the petitioner, namely , Ram Bahadur Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Bakhtiarpur P.S. Case No. 99 of 2017.
