02. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Sections 30(a), 31(1), 32(2) & 38(1) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, the petitioner was the driver of the truck from which about 2,118.60 litres of foreign liquor was recovered. It is contended that co-accused Pramod Kumar has already been granted bail by a Co-ordinate Bench of this Court by order dated 07.07.2017 passed in Cr.

Patna High Court Cr.Misc. No.32453 of 2017 (2) dt.13-07-2017 Misc. No. 30361 of 2017. Petitioner claims that he is having clean antecedent and is in custody since 19.04.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III-cum Special Judge, Excise, Muzaffarpur in connection with Special Excise Case No. 47 of 2017 with a condition that one of the bailors will be the resident of Bihar since the petitioner belongs to Punjab. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
