The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 1491 of 2019 arising out of Palasi P.S. Case No. 357 of 2019, dated 30.10.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 It appears from the First Information Report that 1440 bottles of cough syrup was recovered from the house of one lady who has been made accused in this case. It has been submitted on behalf of the petitioner that there is no recovery from the house of the petitioner

Patna High Court CR. MISC. No.14709 of 2020(2) dt.11-06-2020 2/2 and he has been made accused in this case as his house is situated very close to the place of recovery. The petitioner has clean antecedent.

Considering the facts aforestated, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-Cum-Special Court of Excise, Araria in connection with Special Case No. 1491 of 2019 arising out of Palasi P.S. Case No. 357 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
