18-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 120B/34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other F.I.R. named accused persons committed the murder of son of informant.

It is submitted that present case was instituted on 28.11.2017, but prior to this case, Hussainganj P.S. Case No. 166 of 2017 was already lodged by this petitioner against other family members of informant's side and due to this enmity, petitioner has been falsely implicated in this case. Police, after investigation, submitted final form and exonerated the petitioner, however; differing with the same, learned Magistrate

Patna High Court CR. MISC. No.15698 of 2023(2) dt.18-05-2023 2/2 took cognizance against petitioner also. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IX, Siwan in connection with Hussainganj P.S. Case No. 338 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
