The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Allegation is regarding unknown accused persons having entered into the cabin of Railway gate man and they are said to have snatched away his mobile, jacket, emergency torch and purse etc.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.09.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the confessional

Patna High Court CR. MISC. No.13823 of 2019(2) dt.12-04-2019 2/2 statement of co-accused. Except for this, there is no other substantive evidence to suggest his implication in the present case. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner was not put on Test Identification Parade. Co-accused has been granted bail vide Cr.Misc. No.30120 of 2018.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Kusumbha) P.S. case No.372 of 2016.
