JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 448, 342, 326, 307, 504, 114/34 of the Indian Penal Code. Subsequently under Sections 304B, 498A of the I.P.C was also added.

The prosecution case as per the fardbeyan of the victim Babi Devi is to the effect that on 17.12.2014 she went to demand rice from her brother-in-law Mahendra Mandal when Mahendra Mandal refused to give the same and subsequently Mahendra Mandal and petitioner No. 1 Bipin Mandal started quarrelling with her and at 8:00 P.M when the husband of the informant Pintu Mandal came then Mahendra Mandal and the petitioners ordered to set the informant on fire. The husband of the informant poured the kerosene oil and Mahendra Mandal and Bipin Mandal caught hold of her when

It is submitted by learned counsel for the petitioners that thrust of accusation is against Pintu Mandal who has been acquitted vide order dated 22.01.2016 passed by learned 3rd Additional District & Sessions Judge, Naugachia, Bhagalpur in Sessions Trial No. 570 of 2015.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Bihpur P.S. Case No. 6 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Naugachia, Bhagalpur. With the observations above, the application stands disposed off.
