JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-09-2017 Heard the parties. The appellant seeks regular bail in Parbatta P.S. Case No.16 of 2017 registered for the offence under Sections 341, 323, 307, 379, 353, 504, 506 of the I.P.C. and Section 3(1) ( R ) (S) of SC/ST (Prevention of atrocities) Act.

Allegation against the appellant is of abusing the informant by taking his caste name and tying his neck by gamchha due to which he became unconscious.

Submission of the learned counsel for the appellant is that injury is simple in nature and now the appellant has remained in custody for more than seven months.

Having heard both sides and in view of the facts and

Let the appellant, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge1st(SC/ST Act), Khagariya, in Parbatta P.S. Case No.16 of 2017 subject to the conditions that (1) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The appellant will not induce any witness or tamper with the evidence. (3) The appellant shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
