The appellants are apprehending their arrest in connection with Jehanabad P.S.Cae No.744 of 2017 , registered for offences punishable under Sections 147, 149, 341, 323, 448, 504,354 of the Indian Penal Code and Section 3(1)(r)(s) of Scheduled Caste/Scheduled Tribe (Prevention of Atrocities) Act. Allegation against the appellants is that they abused the informant by caste name and humiliated the family members . Aallegation of assault is against one Ravi Kumar.

Submission of the learned counsel for the appellants is that there is general and omnibus allegation and considering the same, the co-accused Ganesh Keshari has

Patna High Court CR. APP (SJ) No.884 of 2019 dt.16-04-2019 2/2 been granted privilege of anticipatory bail, vide judgment dated 24.01.2019 passed in Cr. Appeal (SJ) No.4705 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the appellants, above named, in the event of arrest or surrender before the learned Special Judge within a period of six weeks from the date of receipt of the order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 1st, Jehanabad in connection with Jehanabad P.S.Case No.744 of 2017, subject to condition as laid under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this appeal is allowed and the impugned order is set aside.
