2. The petitioner is in custody since 26.09.2016 in connection with Sakra P.S. Case No. 260 of 2016 for the offences alleged under Sections 302 and 120B/34 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated and there is no eye-witness to the alleged occurrence merely because the petitioner may have been seen running away from the place of occurrence and that itself is no ground for implication of the petitioner.

4. Learned APP for the State assisted by the learned counsel for the informant appearing suo motu opposes the bail petition submitting that similarly situated co-accused Mahesh Roy @ Mahesh Kumar Roy has been denied bail by this Court in Cr. Misc. No. 7783 of 2017 and co-accused Sanjay Singh @ Sanjay Kumar Singh, who is said to be one of the conspirators of the crime, has also been denied bail by this Court in Cr. Misc. No. 22535 of 2017.

5. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed. (Vikash Jain, J) B.T/Ibrar U T
