For the Petitioner/s :
Mr. Krishna Kumar Yadav, Advocate For the State :
Mr. Nagendra Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA KUMAR ORAL ORDER 02-04-2025 Heard Ld. counsel for the petitioners and Ld. APP for the State.
2. The petitioners seek bail, apprehending their arrest, in connection with Cyber P.S. Case No.167 of 2024, dated 27.05.2024, registered for the offences punishable under Sections 354A, 354C 354D, 500, 504, 506 and 506 of the Indian Penal Code and Sections 66E, 67 and 67A of I.T. Act.
3. As per allegation, both the petitioners used to do indecent behaviour with the informant girl who is student of a college when she went to coaching institute. It is also alleged that the petitioners threatened the informant girl to do as they wanted, otherwise they would upload her obscene photo on
Patna High Court CR. MISC. No.14122 of 2025(2) dt.02-04-2025 2/3 social media and when she required to oblige to do as they wanted, they have uploaded indecent photos and videos in regard to the informant girl by creating a fake ID.
4. Ld. counsel for the Petitioners submits that the Petitioners are innocent and have falsely been implicated in this case. He further submits that the mobile through which obscene photo and video has been uploaded on social media does not belong to the petitioners. He further submits that family of both the petitioners have given some money to the parents of the informant and on demand, she has falsely implicated the petitioners. He further submits that the mother and grandmother of the informant have filed an affidavit to the effect that the case filed by the informant is false.
5. It is also stated in paragraph no. 2 of the petition that no similar petition has earlier been filed by the petitioners either before this Court or before the Hon'ble Apex Court.
6. It has further been stated in paragraph no.3 of the bail petition that the petitioners have no criminal antecedents.
7. However, learned APP for the State vehemently opposes the prayer of the petitioners for bail submitting that it is a case of harassment of innocent girl by the petitioners while she was going for coaching and objectionable photos and videos
Patna High Court CR. MISC. No.14122 of 2025(2) dt.02-04-2025 3/3 of the informant girl have been uploaded on social media and it is only the informant who could know about the offence committed against her and not her family members like mother and grand mother. He further submits that the matter is still at the stage of investigation and at this stage, privilege of anticipatory bail should not be given to the petitioners.
8. Considering the nature of the allegation, I am not persuaded to enlarge the Petitioners on anticipatory bail. The bail petition of the Petitioners is dismissed, accordingly. (Jitendra Kumar, J.) ravishankar/- U T
