Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 28.11.2019 in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

Allegedly, petitioner along with others was caught while he as well as his associates had assembled to make preparation for committing dacoity. According to prosecution case itself, firearm was recovered from possession of other accused and so far as petitioner is concerned, only one mobile

Patna High Court CR. MISC. No.20465 of 2020(2) dt.27-08-2020 2/2 set is said to have been recovered from his possession. The impugned order goes to show that petitioner was remanded in Bela P.S. Case No. 252 of 2019 after institution of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bela P.S.
