Petitioner seeks bail in connection Mansi P.S. Case no. 240 of 2020 registered for the offence punishable under section section 30(a) of Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 26.08.2020, charge sheet has been submitted and petitioner has one criminal antecedent of one case as mentioned in para 3 of the petition. Learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the FIR, it would manifest that 180 liter english wine kept in five bags was recovered.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody

Patna High Court CR. MISC. No.24227 of 2021(2) dt.17-11-2021 2/2 since 26.08.2020 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Khagaria in Mansi P.S. Case no. 240 of 2020.
