JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2026 Heard Mr. Bachan Jee Ojha, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 316(2), 316(5), 338, 336(3), 340(2), 61(2) and 3(5) of the B.N.S..
3. As per prosecution case, it is alleged that three debtors had taken gold loan using fake ornaments. Allegation against petitioner is that he, being a jewel appraiser, has not performed his duty well as he has not checked the authenticity of the said ornaments due to which the bank suffered a financial loss of Rs. 11,20,999/- (eleven lakh twenty thousand nine hundred ninety nine rupees).
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.15284 of 2026(4) dt.14-07-2026 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case merely because he happens to be the jewel appraiser. Petitioner has no concern either with the alleged ornaments or with other co-accused persons. It is further submitted that after two appraisal reports submitted by the petitioner, subsequently, the informant/bank re-verified the gold ornaments by some other person. It is lastly submitted that the two borrowers out of three, namely Ravi Ranjan Kumar and Mukesh Kumar, have already deposited the loan amount in the Bank and both of them have already been granted privilege of anticipatory bail by the learned trial court vide order dated 11.02.2026 passed in A.B.P. No.
2942 of 2025 and order dated 19.03.2026 passed in A.B.P. No. 615 of 2026. Two other similarly situated panelist appraisals, namely Bipin Kumar and Mohan Kumar, have already been granted privilege of anticipatory bail by Coordinate Benches of this Hon'ble Court vide order dated 08.04.2026 passed in Cr. Misc. No. 21962 of 2026 and order dated 15.04.2026 passed in Cr. Misc. No. 20673 of 2026.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and claim based on parity, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned I/c C.J.M., Samastipur in connection with Samastipur (Town) P.S. Case No. 273 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
