15-09-2017 Heard Sri Ashok Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 05-12-2016 in Begusarai Muffasil P.S. Case No. 492 of 2016 registered for offence under Sections 39, 402, 414 of the Indian Penal Code, Sections 25(1-b), 26, 35 of the Arms Act, 1959 and Section 30(A) & 37(c) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

Learned counsel for the petitioner submits that from possession of the petitioner, only one loaded country-made pistol was recovered and petitioner has sufficiently remained in custody, however; in paragraph - 3 of the petition, it has been indicated that besides the present case, the petitioner is an accused in Muffasil (Lakho) P.S. Case No. 482 of 2016

Patna High Court Cr.Misc. No.42590 of 2017(2) dt.15-09-2017 2/2 registered for offence under Sections 302, 379/34 of the Indian Penal Code and 27 of the Arms Act, 1959.

Considering the antecedent of the petitioner, I do not find any ground to extend the privilege of bail. Dismissed.
