The petitioner apprehends his arrest in a case under Sections 323, 504, 406 of the Indian Penal Code. The complainant stated that her husband had purchased LIC policy of yearly premium of Rs. 10,000/-. She further stated that her husband gave Rs. 23,060/- to the petitioner but the petitioner did not deposit the same with the LIC and thus misappropriated the amount. It is submitted that the petitioner never received any money from the husband of the complainant. The husband of the complainant did not file complaint case against the petitioner.
Considering the facts aforesaid and the nature of allegation against the petitioner, the above named petitioner, in the
Patna High Court Cr.Misc. No.12836 of 2016 (3) dt.28-06-2016 2/2 event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Divya Shekhar, Judicial Magistrate 1st Class, Chapra, District Saran in Complaint Case No. 709 of 2015, corresponding to Trial No. 980 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
