Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 401, 353, 332 of the Indian Penal Code and Section 25(1-b)a, 26, 27 of the Arms Act. The recovery of firearm was from possession of co-accused Shushant Kumar. Nothing incriminating was recovered from possession of the petitioner who was arrested at the spot. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where

Patna High Court Cr.Misc. No.5144 of 2018 (2) dt.30-01-2018 2/2 the case is pending in connection with Kotwali (Barari) Police Station Case No. 825 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
