JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in connection with Excise Case No. 2568 of 2019 arising out of Chandi P.S. Case No. 217 of 2019 registered for offences under sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegation made in the First Information Report, on receipt of secret information, the police reached at the place of occurrence. On seeing the police party, three persons fled away from there. On search, the police recovered 20 liters country made Mahua wine from the joint house of the petitioner and the co-accused.

The petitioner has one criminal antecedent of

Patna High Court CR. MISC. No.12847 of 2020(2) dt.13-05-2020 2/2 similar offences as has been stated in paragraph no.3 of the present bail application.

The petitioner is in judicial custody since 28.1.2020.

Looking to the entire facts and circumstances of the case as also considering the present situation arising out of Covid-19 outbreak, let the petitioner, above named, be released on bail on furnishing personal bail bond to the satisfaction of learned 4th Additional Sessions Judge - cum - Special Judge, Excise, Bhojpur at Ara in connection with Excise Case No. 2568 of 2019 arising out of Chandi P.S. Case No. 217 of 2019, subject to the condition that if the petitioner is found involved in future in similar type of offenses, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail granted to the petitioner.
