This application has been filed for grant of regular bail on behalf of the petitioner who is in custody in connection with Patrakar Nagar P. S. Case No. 224 of 2017 instituted for the offences under Sections 406, 420, 414, 467, 468, 471 and 120B of the Indian Penal Code and 66 ( C ) of the I.T. Act. Allegation, according to the informant, is that on suspicion one van was intercepted by police and four persons were found present in the van. On search some documents, cell phones, equipments, devices etc. were found in the van and they disclosed that on the direction of the mastermind behind the NEET question paper leak scam they have come to collect question papers from the bank and send to the respective center.

Patna High Court Cr.Misc. No.38868 of 2017 (2) dt.19-08-2017 It is submitted on behalf of the petitioner that petitioner has falsely been implicated in the present case. He is only a driver of the alleged van and has committed no offence. No incriminating articles have been recovered from his possession. He has got no criminal antecedent. He is in jail custody since 08.05.2017. It has further been stated that similarly situated coaccused persons have been enlarged on bail by a co-ordinate Bench of this Court in Cr. Misc. No. 31209 of 2017 and Cr. Misc. No. 35433 of 2017.

Considering the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-Xth, Patna, in connection with Patrakar Nagar P. S. Case no. 224 of 2017.
