The petitioner apprehends his arrest in Dulhin Bazar P.S. Case No. 179 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325 and 307 of the Indian Penal Code and under Section 27 of the Arms Act. The informant has alleged that the petitioner and other named accused persons have assaulted him and petitioner Jitendra @ Disco Yadav fired causing injury on the right arm of the informant.

It is submitted that there is a case and counter case bearing Dulhin Bazar P.S. Case No. 178 of 2015 registered from the side of the petitioners. Other accused persons have already been granted anticipatory bail.

Patna High Court Cr.Misc. No.14138 of 2016 (4) dt.01-07-2016 2/2 It appears that the case of the petitioner is quite different as there is allegation against the petitioner that he fired causing firearm injury on the right arm of the informant and corresponding injury was also found.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail in Dulhin Bazar P.S. Case No. 179 of 2015, pending in the court of Sri Shyamal Kumar, the Judicial Magistrate, Danapur, Patna. Accordingly, the same is rejected.
