This is an application for bail in connection with Chousa P.S.Case No. 236 of 2016 registered for the offences punishable under Sections 147, 148, 149, 386, 387, 354, 504, 506, 379 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioner is of demand of extortion from the informant and he is accused in five other cases. Submission of learned counsel for the petitioner is that the main accused is other accused person and not the petitioner and there is general and omnibus allegation against the petitioner and one co-accused has been granted bail by a co-ordinate Bench of this Court in Cr.Misc.No.38690 of 2017, vide order dated 19.8.2017. Further submission is that he is in custody for six
Patna High Court Cr.Misc. No.45850 of 2017 (3) dt.11-10-2017 2/3 months and though he is made accused in other cases but he is on bail in those cases.
Heard learned APP also, who could not controvert the above submission.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura, in connection with Chousa P.S.Case No. 236 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled, (3) Petitioner will mark his attendance in local police station in first week of every month
Patna High Court Cr.Misc. No.45850 of 2017 (3) dt.11-10-2017 3/3 at least for one year, so that police may watch his conduct during period of trial, failing which his bail bond shall be cancelled.
