Counter affidavit filed on behalf of the State reveals that the petitioner was initially in Class IV employment since 1973. Subsequently, he has been posted as Amin and finally adjusted as Rajaswa Karamchari. The claim of Assured Career Progression (ACP) is resisted by making such statement in the counter affidavit.

Learned counsel for the petitioner submits that some dues are pending for which the petitioner has made a representation before the Collector, Purnea (Annexure 3).
