JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-07-2017 This application is for grant of bail in connection with Sheohar P.S. Case No. 122 of 2015 registered for the offence(s) under section(s) 302/34 of the Indian Penal Code. Allegation against the petitioners is of causing death of his wife and further prosecution case is that son of the petitioner has informed that the petitioner and other co-accused killed the victim.

Submission of the learned counsel for the petitioner is that there is no allegation of demanding of dowry and the marriage has been solemnized 14-15 years ago and now a false and concocted case has been filed against the petitioner, who is in custody since 8.7.2015. It has further been submitted that nine witnesses have been examined and it is pending only for the

Patna High Court Cr.Misc. No.32470 of 2017 (2) dt.14-07-2017 2/2 evidence of Investigating Officer.

Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, the Trial Court is directed to expedite the trial and conclude the same within maximum period of six months as the petitioner is in custody for about three years. With the above observation and direction, this application is dismissed.
