Petitioner seeks bail in connection with Saharsa Sadar P.S. Case No. 1019/2017 registered for the offences punishable under Sections 363, 366A, 34 of the Indian Penal Code. The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she claimed that she solemnised her marriage with petitioner on her own volition. No doubt, the victim was minor at the time of alleged occurrence but, admittedly, she was matured and she was able to understand the meaning of marriage. Petitioner is in jail custody since 20.9.2019 and the investigation against him has already been completed.

No.12902 of 2020(2) dt.09-06-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa/concerned court in connection with Saharsa Sadar P.S. Case No. 1019/2017.
