The petitioners seek bail in connection with Gaurichak P.S. Case No. 76 of 2023 registered for the offence under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act.
The prosecution case, in brief, is that total 100 liters wine is said to have been recovered from the Motorcycle in question.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 05.02.2023. They have got no criminal antecedent. They have falsely been implicated in the
Patna High Court CR. MISC. No.15291 of 2023(2) dt.01-05-2023 2/2 present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. There is no chance of trial being concluded in near future. It is alleged that total 100 liters wine is recovered from the Motorcycle in question. There is no compliance of Section 100 of Cr.P.C.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioners, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Patna City, in connection with Gaurichak P.S.
