JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 This appeal has been filed for grant of bail in connection with Kotwa (SC/ST) P.S.Case No. 87 of 2016 registered for the offences under Sections 363/34 of the Indian Penal Code and 3(1)(x) of SC/ST Act and for setting aside the impugned order dated 17.6.2017 passed by 1st Additional Sessions Judge-cumSpecial Judge, SC/ST Act, East Champaran at Motihari. Allegation against the appellant and other co-accused persons is of kidnapping minor daughter of the informant. Submission of learned counsel for the appellant is that he has been made accused in this case only because of the fact that and main accused and the girl used to come to his shop and he is in custody for two months and he is ready to abide by any condition that may be imposed by this Court if bail is granted.
Patna High Court CR. APP (SJ) No.1997 of 2017 (4) dt.24-08-2017 2/2 Heard learned Special P.P., who has opposed the prayer for bail.
In the facts and circumstances, the appeal is allowed and the impugned order is set aside. Let appellant, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, SC/ST Act, East Champaran, Motihari, in connection with Kotwa (SC/ST) P.S.Case No. 87 of 2016, subject to the condition that appellant shall co-operate in investigation and with regard to recovery of girl and he will appear in first week of every month in Police Station till the recovery of the girl.
