JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-01-2021 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehends their arrest in connection with Lakhisarai (Amhara) P.S. Case No. 689/2019 registered for the offences punishable under Sections 147, 148, 149, 385, 387/504 of the Indian Penal Code and 27 of the Arms Act. Petitioners are said to have opened fire of their respective firearms. Furthermore, it is alleged that petitioner No. 4, namely, Indradeo Yadav, one day prior to alleged occurrence demanded ransom from the informant. However, in course of

No.20824 of 2020(3) dt.25-01-2021 2/2 investigation, it has come that there was land dispute between the parties since long and both persons lodged cases against each others, which is evident from paragraph 39 of the case diary, which is supervision note of Dy.S.P.. No doubt, the petitioners do have criminal antecedents but considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that above named petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai/concerned court in Lakhisarai (Amhara) P.S. Case No. 689/2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
