Petitioner, already in custody, seeks bail in Maner PS Case No. 89 of 2017, registered under Sections 302/34 of the IPC and Section 27 of the Arms Act.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, there is specific allegation of assault against three accused persons named in the FIR namely Dara Singh @ Prabhunath Singh, Horil Rai @ Nagendra Rai and Pintu Kumar, the petitioner was implicated after five months on the basis of confessional statement of co-accused Vishal Kumar and similarly situated other co-accused namely Hari Om Kumar, Sanjiw Kumar @ Phuto and Bahadur Rai have been admitted to bail by this Court as well as by coordinate Bench of this Court.

Having considered the said facts and circumstances, the petitioner Sushil Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VI Danapur in connection with Maner PS Case No. 89 of 2017.
