====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 29-07-2016 Heard the learned counsel for the petitioner. Perused the order passed by the Court below dated 01.02.2016 passed by the learned Sub Judge V, Biharsharif at Nalanda.

From perusal of the impugned order, I find that this is a case in which it can very well be said that it is frivolous, vexatious, illdecisively filed by the petitioner only with a view to delay the matter. It further appears that the petitioner is trying to abuse the process of the Court.

Accordingly, this writ application is dismissed with cost of Rs.5000/- to be paid by the petitioner to the respondent in the Court below within one month failing which the same shall be realized by the Court according to law.
