JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.2.2018 seeks bail in Barauli PS Case No. 48 of 2018 registered under Sections 21 and 22 of the NDPS Act.
The allegation in brief is that in the husk kept in a room 7.500 Kilograms of ganja was recovered from the house of the petitioner.
Learned Counsel for the petitioner submits that the said room was accessable to many persons, however the quantity of the seized ganja is very small and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Ram Ratan Singh is directed to be released on bail after framing of the charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Gopalganj in connection with Barauli PS Case No. 48 of 2018.
