13-09-2017 Heard Sri Rajeev Kumar Singh, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Akhileshwar Prasad Singh, learned senior counsel assisted by Sri Bimal Kumar, learned counsel for the informant. This is the second attempt for grant of bail on behalf of the petitioner. Earlier, the prayer for bail of the petitioner was rejected by order dated 22-08-2016 passed in Cr. Misc. No. 34628 of 2016.

Learned counsel for the petitioner tried to persuade the Court that one of the co-accused, almost on similar accusation, was granted bail by this Court and as such, on the plea of parity, he has prayed for extending the privilege of bail to the petitioner.

No.36058 of 2017(3) dt.13-09-2017 2/2 However, on perusal of the order dated 22-08-2016, whereby the prayer for bail of petitioner was rejected, it is evident that petitioner was convicted in a case for offence under Section 302 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act, 1959 and even after being released on bail in the said case, he has committed murder in the present case.

Considering the seriousness of the accusation, the Court is of the opinion that there is no point to consider the prayer for renewal of his bail petition.

The petition again stands dismissed.
