The petitioner seeks regular bail in connection with Madhepura (Ghailardh) P.S. Case No. 1094 of 2018 registered for the offence punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The allegation is regarding the Police patrolling party having apprehended some accused persons, including the petitioner herein, who were moving in suspicious condition and upon search being made, though no recovery was made, as far as the petitioner is concerned, however, one country made pistol along with one life cartridge was recovered from the co-accused person, namely, Indramohan Kumar Paswan.

It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 26.12.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Ghailardh) P.S. Case No. 1094 of 2018.
