====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 126(2), 115, 118(1), 109, 132, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, all the FIR named accused persons including these petitioners assaulted the officials of Excise Department when they were trying to make raid in the village as a result of which some of them sustained injuries.

4. Learned counsel appearing for the petitioners while denying the allegations, submits that these petitioners have falsely been implicated in the case. Allegation of assault is general and omnibus and no specific overt act has been alleged against these petitioners.

5. Learned counsel for the State opposes the prayer for bail. He submits that the petitioners are named in the FIR with specific allegation that they and other accused persons were involved in marpit with the Excise officials as a result of

Patna High Court CR. MISC. No.15013 of 2025(2) dt.08-04-2025 2/2 which some of them sustained injuries.

6. Since, petitioners are alleged to have involved in attack on Government officials, considering the nature and gravity of allegation, prayer for bail of these petitioners is rejected.
