====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Section 394 of the IPC.

The prosecution story, in brief, is that the informant who is D.B.O. in Bhandan Bank of Nathnagar was doing collection as per Bank Policy and was coming with cash amount of Rs. 98,705/- was intercepted by three persons, who were on bike and told him to stop and pointed pistol towards him and threw the key of the bike. Thereafter, they snatched the bag of informant having cash and details as mentioned in F.I.R. and flee away.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 16.10.2019. The petitioner has falsely been implicated in the present case.

Patna High Court CR. MISC. No.12699 of 2020(2) dt.05-03-2020 2/2 Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner has been made accused in the present case on his self confession made before the police. Rs. 40,000/- is said to have been recovered from possession of the petitioner. He claimed that the said recovered amount is of him. The petitioner has not been put on T.I. Parade to ascertain his participation in the alleged occurrence. The recovered Rs. 40,000/- has also not been put on T.I. Parade to ensure whether the said amount is a looted amount or not.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- I, Bhagalpur, in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 516 of 2019.
