The petitioner has preferred this application for grant of regular bail in a case registered under sections 22 and 23 of the NDPS Act.
As per the prosecution case, 2.6 kgs of ganja is stated to have been recovered behind the hospital and the petitioner and other accused persons who were standing nearby were taken into custody.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case. The petitioner is in custody since 22.1.2021 and charge sheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, petitioner not having any criminal antecedent and having remained in custody for 10 months, the Court directs the petitioner to be enlarged on bail in connection with Ladaniya P.S. Case no. 13 of 2021 (corresponding to G.R. no. 2 of 2021, N.D.P.S Case no. 2 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Madhubani.
