This case was taken up at 10.30 A.M. when no one appeared. Once again at 12:00 P.M. on call, no one appeared on behalf of the petitioner.
The petitioner has moved before this Court under Section 482 of the Code of Criminal Procedure for quashing of the FIR bearing Bihta P.S. Case No. 324 of 2015. From the averments, it has further came to notice that the petitioner had preferred anticipatory bail as also bail on two occasions all of which were rejected in the year 2016 and 2017 respectively.
As per the prosecution story, allegation is that the petitioner in connivance with the other accused persons killed the son of one Govind Yadav as he failed to accept his demand
Patna High Court CR. MISC. No.6142 of 2018(2) dt.19-01-2023 2/2 for paying the extortion amount of Rs. 80,000/-. The allegation is that when he was driving the motorcycle, he was deliberately crushed under the wheels of the truck.
In the opinion of the Court, there is allegation of murder against the petitioner and certainly this is not a fit case to interfere under Section 482 of the Cr.P.C. Accordingly, the application stands dismissed. (Rajiv Roy, J) JagdishNeha/- U T
