The petitioner seeks regular bail in connection with Complaint Case No. 2145 of 2014 for the offences punishable under Sections 420, 467, 468/34 of the Indian Penal Code. The allegation is regarding commission of fraud by the petitioner in the sale and purchase of the land. The learned counsel for the petitioner submits that the complainant is the step brother of the petitioner and civil cases are going on between them with regard to declaration of title of the disputed land. It is submitted that the petitioner has been falsely implicated in the present case and at best the present case

Patna High Court CR. MISC. No. 16688 of 2019(2) dt.01-04-2019 2/2 is civil in nature and the appropriate remedy for the complainant is to approach the competent court of civil jurisdiction. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 29.05.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IXth, Gaya in connection with Complaint Case No. 2145 of 2014.
