Petitioners apprehend their arrest in Hisua P.S. Case No.251 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant got information that in village Tungi, the villagers were manufacturing liquor on large scale. On such information, a raid was conducted but found two persons fleeing away. When the informant reached near the house of the petitioners, the petitioners started fleeing away but on search, 60 litres of liquor made of Mahua was recovered. Learned counsel for the petitioners submits that the petitioners are brothers and the recovery is made from a joint

Patna High Court CR. MISC. No.14604 of 2020(2) dt.03-09-2020 2/2 family house and the petitioners are not responsible for the said recovery, but it appears that 60 litres of liquor made of Mahua was recovered from the house of the petitioners. Having considered the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
