The petitioner has preferred this application for grant of regular bail in a case registered under section 356/379 of the Indian Penal Code.
As per the prosecution case, an amount of Rs. 2,45,00/- was taken away by two unknown miscreants boarded on motorcycle from the informant.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is also accused in four other criminal
Patna High Court CR. MISC. No.15141 of 2022(2) dt.12-07-2022 2/2 cases which are of similar nature as stated at para 3 of the bail petition. The petitioner was remanded from Barun P.S. Case No. 316 of 2021 in this case. The petitioner is in custody since 10.12.2021.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Aurangabad, in connection with Aurangabad (Town) P.S. Case No. 398 of 2021, with a condition that :-
1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled. The application stands allowed.
