Petitioner seeks bail in Sherghati (Dobhi) P.S. Case No.47 of 2016 registered under Section 395 of the IPC. The informant (truck driver) disclosed that some unknown persons committed dacoity and looted away the truck loaded with 333 bags of wheat.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The looted truck was recovered in front of Sardar Nanak Singh Kochar Petrol Pump. 105 bags of looted wheat were also recovered. The petitioner was arrested on the basis of confessional statement and remanded in this case on 11.12.2019 but the petitioner has not been put on T.I.P.

Having considered the facts that save and except the

No.13146 of 2020(2) dt.03-03-2020 2/2 confessional statement of co-accused, nothing has been recovered from possession of the petitioner and even after the petitioner being arrested, he was not put on T.I.P, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Sherghati, District-Gaya in connection with Sherghati (Dobhi) P.S. Case No.47 of 2016.
