The petitioner seeks bail in anticipation of his arrest in connection with Nayagawn P.S. Case No. 64 of 2018 dated 12.05.2018 instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

The informant has alleged that the petitioner and one Hakim Rai used to run a brewery on a land which was contiguous to the land of the informant which the petitioner and Hakim Rai wanted to purchase and for which the informant was not ready. It has been alleged that on one occasion, the informant was divested of Rs. 20,000/- and co-accused Hakim Rai is said to have given him a knife blow.

No.14132 of 2019(2) dt.08-03-2019 2/2 Learned counsel for the petitioner has submitted that during the course of investigation, it has come to light that the occurrence took place between the parties in an inebriated condition and the act of assault by knife is attributed to co-accused Hakim Rai who has been granted regular bail by the court below. Regard being had to the nature of accusation and the clean antecedent of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-13, Saran at Chapra in connection with Nayagawn P.S. Case No. 64 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
