JUSTICE ARUN KUMAR ORAL ORDER 12-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 30.1.2018, seeks bail in Jagdishpur PS Case No. 98 of 2017 registered under Section 395 of the IPC.

It is submitted that neither any incriminating material has been recovered from the possession of the petitioner nor he was put on TIP and only material against the petitioner is disclosure of his name in the confessional statement of co-accused Santosh Kumar, who has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 36017 of 2017, and this petitioner has one criminal antecedent of making attempt to commit theft. Having considered the said facts and circumstances, the petitioner, namely, Dasrath Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhagalpur in connection with Jagdishpur PS Case No. 98 of 2017.
